Terms of Service

These Terms of Service ("Terms") govern your access to and use of SmartCard Platform ("the Service", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SmartCard Platform provides digital business cards, NFC tap-to-share profiles, and a built-in lightweight CRM (contacts, leads, opportunities, notes, and attachments) for companies and their teams. Features available to your account depend on your selected subscription plan.

2. Accounts and Company Registration

When you register a company, you become that company's owner and are responsible for the accuracy of the information provided, for managing users you invite into your company, and for keeping your login credentials secure. You must be legally able to enter into a binding contract to register.

3. Subscriptions, Trials, and Billing

Paid plans are billed on the cycle shown at checkout (monthly or yearly) and processed through our payment provider, Stripe. Some plans include a free trial period; unless cancelled before the trial ends, the subscription continues under the plan's regular terms. You may cancel or change your plan at any time from your account; cancellation takes effect at the end of the current billing period unless stated otherwise.

4. Acceptable Use

You agree not to use the Service to store or share unlawful, infringing, or harmful content, to attempt unauthorized access to any account or data other than your own company's, to upload files that are not what they claim to be (e.g. disguising executable code as a document), or to interfere with the normal operation of the Service.

5. Your Content

You retain ownership of the content you upload — card profiles, photos, contacts, notes, and attachments. You grant us a limited license to store, process, and display that content solely to operate the Service on your behalf. You are responsible for having the rights to any content you upload.

6. Public Card Pages

Digital business cards you publish are intended to be viewed publicly by anyone with the card's link or who taps the associated NFC tag. Do not publish information on a card profile that you do not intend to be publicly visible.

7. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if these Terms are violated, if required by law, or if a subscription remains unpaid after a reasonable grace period.

8. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, SmartCard Platform is not liable for indirect, incidental, or consequential damages arising from use of the Service.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be highlighted on this page.

10. Governing Law

These Terms are currently governed by the laws applicable in Iraq, pending finalization of the entity's official place of registration, at which point this section will be updated to reflect the entity's registered jurisdiction.
